These Terms of Use govern access to and use of the deephate.ai website. By using the Service, you confirm that you have read, understood, and accepted these Terms of Use.

If you do not agree to these Terms, you must not use the Service.

1. Who provides the Service

In these Terms, the words “we,” “us,” and “our” refer to the owner of the Service, and the words “you” and “user” refer to the person using the Service.

2. What the Service is

deephate.ai is an online service that provides the user with a unified interface for accessing third-party artificial intelligence models, including the ability to interact with such models in a chat format.

The Service may include access to multiple AI model providers, selection of models and interaction modes, storage of chat history, plan-based and usage-based limits, additional interaction elements that affect the form and style of communication in chat, as well as paid and free features.

The Service is primarily entertainment-oriented and experimental in nature. It is not intended to be used as the sole or primary source of facts, professional recommendations, or critical decisions.

3. Age restrictions

The Service is intended only for individuals who are 18 years of age or older, unless expressly stated otherwise.

By using the Service, you confirm that you have reached the required age and have the legal capacity to enter into binding agreements under applicable law.

We may refuse access, restrict access, or delete an account if we have reason to believe that a user does not meet the age requirements.

4. Account and sign-in methods

Access to certain features of the Service may require you to create an account or sign in using a supported sign-in method, including sign-in through third-party authentication services, sign-in via a one-time link, and guest mode, if available.

You are responsible for maintaining access to your email account, third-party account, and the devices through which you use the Service.

You may not impersonate another person, use someone else’s account without permission, create multiple accounts to circumvent restrictions, or use automation tools unless expressly permitted by the Service.

We may restrict, suspend, or terminate access to an account if we suspect abuse, fraud, circumvention of restrictions, violation of these Terms, or violation of applicable law.

5. Access to third-party models

The Service provides an interface for accessing artificial intelligence models that may be owned and maintained by third parties.

You understand and agree that we are not the developer or owner of most of the models used through the Service, do not control the underlying training, weights, architecture, or internal operating rules of such models, and that the availability of specific models, the quality of responses, speed of operation, limitations, and model behavior may change without prior notice. The use of certain models may also be subject to additional rules and restrictions imposed by the relevant providers.

We may at any time add or remove models, change feature availability, restrict certain usage modes, and modify limits if necessary for stability, security, or compliance with obligations to model providers.

6. Nature of responses and no guarantees regarding content

Responses in the Service are automatically generated by third-party artificial intelligence models.

You understand and agree that we do not create response content ourselves and do not control the underlying training, internal architecture, or all possible forms of response content. Responses may be inaccurate, incomplete, outdated, fabricated, contradictory, offensive, strange, or otherwise inappropriate.

Responses do not constitute professional advice. They must not be treated as medical, legal, financial, psychological, employment, investment, or any other form of professional advice.

You must independently verify any information obtained through the Service before using it, publishing it, sharing it with third parties, or making decisions based on it.

In some cases, responses may contain unwanted, objectionable, prohibited, dangerous, or otherwise unacceptable content. We do not endorse the obtaining, searching for, distribution, or use of prohibited, dangerous, or unlawful information.

7. Entertainment-oriented and experimental nature of the Service

The Service is designed as a tool for communication and interaction with artificial intelligence models, including in an entertainment format.

Although some responses may be practically useful, the Service is not presented as a guaranteed reliable working tool. You use it at your own risk and discretion.

No descriptions of the Service, website publications, marketing materials, playful tone of presentation, interface elements, or model behavior should be interpreted as a promise of accuracy, usefulness, psychological safety, or fitness of the Service for any particular purpose.

8. What you may do

Subject to these Terms, we grant you a limited, revocable, non-exclusive, and non-transferable right to use the Service for personal, lawful, and permitted purposes.

You may create chats, send prompts to models, use available interface features, view and retain responses as part of ordinary use of the Service, and purchase paid access to features if such features are available.

9. Prohibited use

You may not use the Service to violate the law, cause harm to people, organizations, infrastructure, or the rights of others, create, distribute, or obtain unlawful content, engage in fraud, deception, phishing, malware, spam, or harassment.

You may not use the Service to publish or transmit another person’s personal data without a sufficient legal basis, to circumvent technical, pricing, protective, or other restrictions of the Service, to mass-create accounts, guest profiles, or requests in order to bypass limits, to test, undermine, or bypass the protective mechanisms of the models or the Service, or to use the Service in high-risk areas without mandatory independent human review.

You also may not use the Service for actions likely to lead to complaints from rights holders, model providers, payment services, government authorities, or other third parties, for operating the Service in a way that may violate the rules of model providers or infrastructure providers, or for causing harm to yourself or others.

In particular, you may not use the Service to prepare, encourage, justify, organize, or facilitate suicide, self-harm, violence, threats, murder, bodily injury, unlawful deprivation of liberty, abuse, destruction of property, or other crimes. The searching for, obtaining, distribution, or practical application of dangerous, prohibited, or unlawful information is also prohibited.

We may independently determine whether specific use constitutes abuse or a violation of these Terms.

10. High-risk and crisis use is prohibited

You may not use the Service as the sole or primary basis for medical decisions, legal conclusions, financial or investment decisions, employment decisions, insurance decisions, decisions related to the safety of individuals, creditworthiness assessments, or any actions capable of affecting the rights, health, liberty, income, or safety of a specific person.

You also may not use the Service in crisis, dangerous, emergency, or other situations in which an error, provocation, inaccuracy, or incompleteness in a response could result in death, bodily harm, self-harm, violence, unlawful conduct, or other serious consequences.

If you use materials obtained through the Service in more serious scenarios, you must ensure independent human review and bear full responsibility for the consequences of such use.

11. Your materials and your warranties

You are responsible for all materials you submit through the Service, including prompt texts, message content, files if file uploads are available, data you place in public links, and any other materials submitted through the Service interface.

By using the Service, you represent and warrant that you have the right to submit such materials, that their use does not violate the law, third-party rights, contractual obligations, or confidentiality requirements, and that you do not submit data that you are not entitled to disclose.

You understand that the content of prompts may be transmitted to AI model providers for the purpose of generating a response.

If the Service allows you to create public links to a chat or part of a chat, you understand and agree that the contents of such chat may become accessible to any person who obtains the relevant link.

You are solely responsible for the decision to make a chat public, for the content disclosed through a public link, for the consequences of publishing such a link, and for ensuring that the published chat does not contain personal, sensitive, confidential, or otherwise protected data.

We are not required to review the contents of public links in advance, but we may restrict, remove, or disable them at any time.

13. Storage of chat history

We may store chat history, messages, settings, and related technical data in accordance with the Privacy Policy.

You understand that message history may be stored on the Service side, and that chat content may be used for the operation of features, investigation of abuse, support, and ensuring stability and security. Deletion of an account or individual chats may not result in the immediate deletion of all related technical records.

14. Paid features, plans, and limitations

Certain features of the Service may be provided for a fee.

Free access to the Service is supported by advertising. By using the Service on a free plan (including guest access), you agree that advertising may be displayed in the Service interface and that advertising partners may use cookies and similar technologies to deliver ads. If you prefer to use the Service without advertising, you may purchase a paid plan.

If you purchase a paid plan, you agree that access to features depends on the selected plan, usage limitations may vary depending on the plan, and prices, feature sets, limits, available models, rooms, modes, settings, and other elements of the Service may change.

We do not guarantee that the limits, set of models, order of rooms, modes, settings, and other Service parameters available at the time of payment will remain unchanged. Renewal, expiration, suspension, or termination of a plan may depend on receipt of payment and confirmation from the payment service provider.

We may change, restrict, or terminate access to certain features if necessary for stability, security, compliance with provider requirements, or changes in the operating conditions of third-party providers. We may also refuse to provide paid features if we suspect fraud, payment abuse, chargebacks, or violation of these Terms.

Unless expressly stated otherwise, paid access grants the right to use the paid capabilities of the Service during the relevant period, but does not guarantee the immutability of any specific set of features, models, limits, rooms, modes, or settings.

15. Refunds and payment disputes

General rules regarding refunds, subscription cancellations, and payment dispute handling may be additionally published on the website or communicated to the user in the payment interface.

Unless otherwise expressly required by mandatory applicable law, we may refuse a refund where access to a paid feature has already been provided, the plan has actually been used, or there are signs of abuse, fraud, or violation of these Terms.

16. Right to moderate, restrict, and block

We may, at our sole discretion and without prior notice, restrict certain features, reject requests, hide, remove, or restrict content, disable public links, suspend or delete accounts, restrict access to specific models, apply technical measures against abuse, and provide necessary information to providers, payment services, hosting providers, or competent authorities if required for investigating violations, protecting rights, or complying with the law.

We may immediately restrict, interrupt, or block the use of the Service if we determine that requests, user behavior, or circumstances of use may indicate a risk of self-harm, harm to others, commission of a crime, circumvention of protective mechanisms, abuse, or other dangerous use.

We are not required to disclose in detail the internal criteria used to detect abuse if doing so may reduce the security of the Service.

17. Rights to the Service

All rights to the website, interface, software, design, structure, selection of features, texts, graphics, designations, logos, and other elements of the Service, excluding third-party rights and user materials, belong to us or are used by us on a lawful basis.

You are not granted the right to copy the Service in whole or in substantial part, distribute, sell, rent, lease, or resell access to the Service, decompile, extract source code, or attempt to reconstruct internal logic except where mandatory law permits otherwise, or use Service materials to create a competing product in a way that violates the law or contractual restrictions.

18. Rights to your materials and to responses

You retain rights to your materials to the extent those rights belong to you under the law.

At the same time, by using the Service, you grant us the right, to the extent necessary for operation of the Service, to store, process, transmit to model providers, display, and use for the purposes of Service functionality, security, statistics, diagnostics, and dispute resolution the materials you submit through the Service interface.

If applicable law or the terms of the relevant model provider allow rights in an automatically generated response to arise in your favor, such rights belong to you to the extent permitted by law and by the rules of the relevant provider.

19. No warranties

The Service is provided “as is” and “as available” to the fullest extent permitted by law.

We do not guarantee that the Service will operate uninterrupted, error-free, or without delay, that responses will be accurate, useful, or suitable for your purpose, that all models will remain continuously available, that the Service will be compatible with any device, browser, or infrastructure, that features will not be changed, restricted, or terminated, or that use of the Service will not result in unwanted, provocative, prohibited, dangerous, or otherwise unsuitable content.

20. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect damages, lost profits, loss of data, income, reputation, or business opportunities, consequences of using or being unable to use the Service, the content of responses from third-party models as guaranteed accurate information, actions of third parties including model providers, payment services, hosting providers, or advertising networks, or for actions, decisions, or omissions of the user in the real world based on materials obtained through the Service, unless otherwise expressly required by mandatory applicable law.

Nothing in these Terms excludes or limits user rights or liability that cannot be excluded or limited under applicable law.

If applicable law permits limitation of our liability, the aggregate liability of the owner of the Service for contractual claims related to use of the Service will not exceed the amount actually paid by the user for use of the Service during the 12 months preceding the event giving rise to the claim.

21. Indemnification by you

You agree to indemnify us for losses, expenses, and third-party claims arising out of your materials, your violation of these Terms, unlawful use of the Service, violation of third-party rights, abuse of paid features, public links, sign-in methods, or Service restrictions, as well as your actions taken in violation of these Terms or applicable law, if such actions result in claims, losses, or expenses for us.

This section applies only to the extent permitted by applicable law.

22. Termination of access

You may stop using the Service at any time.

We may terminate or restrict your access in whole or in part at any time if you violate these Terms, if use of the Service creates a risk for us, other users, model providers, or infrastructure, if required by law, a complaint from a rights holder, a model provider, a payment service, or a competent authority, or if continuing to provide the Service becomes technically, economically, or legally impracticable.

Upon termination of access, your right to use the Service ends. Certain data may remain stored in accordance with the Privacy Policy. Sections concerning payments, liability, rights to materials, disclaimer of warranties, indemnification, and dispute resolution will survive termination of access.

23. Changes to the Service and these Terms

We may at any time change or discontinue certain features, change the set of available models, change the interface, mechanics, limits, pricing plans, and rules of use, and update these Terms.

The current version of the Terms is published on the website with the date of the latest update. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

24. Disputes and how they are handled

If you have a dispute, claim, or question, you must first send an inquiry to deephate@proton.me and attempt to resolve the matter out of court.

If the dispute is not resolved out of court, it shall be resolved in the manner and jurisdiction determined by applicable law.
